A Dutch product

Terms and conditions

This is a translation for your convenience. In the event of differences, the Dutch version prevails.

Article 1 - Definitions

  1. Entrepreneur: AKRM Online Services, based in Dronten, registered with the Dutch Chamber of Commerce under number 95210415.
  2. Brand name: Qiicode.
  3. Product name: Qiicode keychain.
  4. Website names: www.qiicode.nl and the domains that redirect to it: helpikbenmijnsleutelskwijt.nl, qiicode.com and helpivelostmykeys.com.
  5. Customer: the natural person or legal entity entering into a contract with the entrepreneur.
  6. Product: the card with keychain and home card, with a unique key code, as offered on the website.
  7. Contract: the purchase contract between the customer and the entrepreneur that is formed when an order is placed.

Article 2 - Applicability

  1. These terms and conditions apply to all contracts, offers and deliveries of the entrepreneur.
  2. Deviations from these terms are only valid if agreed in writing.

Article 3 - Offer and contract

  1. The offer on the website is without obligation and may be changed by the entrepreneur.
  2. A contract is formed as soon as the customer has placed the order and the entrepreneur has confirmed it in writing or electronically.

Article 4 - Prices and payment

  1. All prices on the website include VAT and exclude shipping costs, unless stated otherwise.
  2. Payment is made through the payment methods offered on the website.
  3. The entrepreneur reserves the right to suspend delivery until full payment has been received.

Article 5 - Delivery and performance

  1. The entrepreneur carries out the order with care and ensures that the product is shipped within the stated delivery time.
  2. The entrepreneur is not liable for delays beyond its control.
  3. Delivery takes place at the address in the Netherlands provided by the customer.

Article 6 - Right of withdrawal

  1. The customer has the right to dissolve the contract within 14 days of receiving the product without giving a reason.
  2. To exercise the right of withdrawal, the customer contacts us at info [at] qiicode.nl.
  3. The product must be returned unused and in its original condition. Unused means that the scratch layers are completely undamaged; a card that has been (partly) scratched off counts as used. The costs of returning are paid by the customer.

Article 7 - Privacy and data protection

  1. The entrepreneur processes personal data in accordance with applicable privacy legislation.
  2. No personal details are needed to log in to and use the service; the key code and password are enough.
  3. Both the customer and the website user are responsible for their own privacy. Sharing personal details with others is not necessary and is discouraged.
  4. The entrepreneur is not responsible for the consequences of communication between users (the owner and the finder of the keychain).
  5. Linking an email address to the code profile is optional. The customer then also receives incoming messages by email. By providing an email address, the user links a personal detail to the key code, which may lead to their identity being discovered.
  6. It is not possible to change or recover a password. This policy has been set to protect users' privacy.
  7. The customer receives a card consisting of two parts. The keychain carries the key code, and the home card carries the key code and the password for logging in. These details are covered by a scratch layer, so it cannot be seen at shipping which card goes to a customer. When processing orders, a random card is taken from stock, and the entrepreneur does not record which card is sent to which customer. As a result, an order is not linked to a key code.
  8. The customer can write a finder's note. This is a message shown to a finder who wants to send the owner a message through the website. The note can contain instructions, such as "Please hand in at the town hall in Zwolle". It is up to the owner how much information they share. The entrepreneur is not liable for the consequences of information in the finder's note.
  9. Personal details such as name, address and email address are needed to order. They are used only to process and ship the order and are not linked to the key code.
  10. For more information, see the privacy statement.

Article 8 - Liability

  1. The entrepreneur is not liable for indirect damage, including loss of keys or unauthorised access to the keychain.
  2. The entrepreneur is not responsible for damage arising from the use of communication through the website.
  3. The liability of the entrepreneur is limited to the value of the ordered product.

Article 9 - Complaints

  1. Complaints about the product or service can be submitted to info [at] qiicode.nl.
  2. The entrepreneur aims to handle complaints within 14 days.

Article 10 - Applicable law

  1. Dutch law applies to all contracts.
  2. Disputes are submitted to the competent court in the district where the entrepreneur is based.

Article 11 - Wear and damage

  1. The Qiicode keychain is made of PVC and has the key code printed on its surface. Normal wear through use, including but not limited to fading of the key code, is the responsibility of the customer. Qiicode is not liable for the code becoming illegible through wear, scratches or other use-related damage.
  2. Damage, deformation or breakage of the keychain, whatever the cause, is at the customer's expense and risk. Qiicode offers no guarantee for damage resulting from normal use, incorrect use, external factors or accidents.
  3. The eyelet of the keychain, through which the key ring passes, can wear or break through turning, strain and normal use. This counts as normal wear and is at the customer's expense and risk.
  4. The customer is advised to handle the keychain with care and keep the key code legible.

Article 12 - Availability of the service

  1. Qiicode aims to keep the website and associated service available for at least one year from the time of purchase of a Qiicode keychain.
  2. Qiicode reserves the right to change, suspend or end the service in the event of unforeseen circumstances, such as but not limited to force majeure, legal restrictions, technical problems or termination of the business.
  3. In the event of a planned end of the service, Qiicode will, where reasonably possible, inform users in good time through the website or other available communication channels.
  4. Qiicode is not liable for any damage or costs arising from the change, suspension or end of the service.
  5. Qiicode does not guarantee that lost keys will be found. Our service makes communication between finder and owner possible, but its success depends on third parties.
  6. Users are responsible for keeping their key code and password safe. Qiicode cannot be held liable for loss or misuse of these details.
  7. We are not liable for indirect damage, consequential damage or loss of profit.

Article 13 - Changes to the terms and conditions

  1. Qiicode reserves the right to change these terms and conditions at any time. Changes are announced on our website and take effect on publication.
